Please review and agree to the entire Rental Agreement before proceeding. You agree to all policies, terms, and conditions by booking this reservation for property located at 8515 Gulf Blvd, Navarre, FL. 32566

 

A. The property shall not be used by more than the number of adults and children listed in your reservation. Failure to comply may result in immediate termination of reservation, removal from the property and forfeiture of any monies paid.

 

B.  Criminal activity of any kind is not permitted, such as under-age drinking or use of drugs. No parties or events are allowed on the property.

 

C. Pool hours and rules are posted at the pool area. Please abide by all rules and pool hours. No exceptions. Pool bands must be worn by everyone in your group while using the pool area. If they are too large for the children, please have them with you to show to pool security.  There will be a $10 charge for each missing pool bracelet

 

D. Animals.  No animals or pets of any kind are permitted at the Property, unless a service dog; which requires written notification to the Owner when booking. If unauthorized pets are found present it will result in immediate removal from property, no refunds and an additional $250 cleaning fee.

 

E. Renter must be at least 25 years of age. Guests under the minimum age must be accompanied by a parent or legal guardian during the entire stay.

 

F. No smoking inside the unit. There is an ashtray on the balcony, so if smoking outside, you must keep the sliding doors closed.

 

G. No grills allowed on the balconies. There are community charcoal grills located near the pool and also picnic tables. Please be considerate of others and be efficient with your grilling time and clean up after your group.

 

H. Renter is liable for any damage to the property and agrees to accept charges should damage occur during occupancy. If damages exceed the damage deposit, renter will be responsible to pay amount of damages that are above and beyond deposit.

 

I. You agree to provide us with proof of age with a valid photo ID. The Rental Agreement and Photo ID must be from the same guest and that guest will be held responsible for the property during the stay. A parent or legal guardian must accompany all guests who are under the Minimum Age for the entire duration of the rental.

 

 

 

RULES AND REGULATIONS

 

1. Responsible Renter. As the Renter, you agree to be an occupant of the Property for the entire duration of the rental. All other occupants will be family members, friends, other responsible adults over the Minimum Age, or accompanied by a parent or legal guardian. You agree to be solely responsible for your actions and the actions of all family members, guests, and invitees (collectively, “Occupants”) present at the Property at any time during your stay, and to ensure that all Occupants understand and comply with the Terms.  Owner is not responsible for personal injury while on the premises.

 

2. Good Neighbor Policy.  Because the Property is a privately owned condo, all Occupants must comply with this good neighbor policy. Please treat the Property with the same care you would use with your own residence and leave it in the same condition it was in when you arrived. To prevent theft of or damage to furnishings or your personal property, you agree to close and lock doors and windows when you are not present at the Property and upon check-out. You and other Occupants agree to conduct yourselves throughout your stay in a manner that is respectful of and not disruptive to neighbors, traffic flow, or the community and that will not prompt complaints to owners from police, neighbors, or neighborhood or homeowner associations. Noise audible outside the Property is prohibited between 10 p.m. and 8 a.m., this INCLUDES the balcony. You and other Occupants agree to abide by all applicable parking restrictions and limitations, to include no parking of boats, jet skis/wave runners, or trailers

 

3. Maximum Occupancy. Under no circumstances, can the number of people present at the Property exceed the maximum posted occupancy of 8 guests, unless owner has given you advance written permission. Failure to obey may result in immediate termination of reservation, immediate removal of all individuals and forfeiture of any monies paid.

 

4. No Smoking.  No smoking of tobacco, medical marijuana or vaping is permitted inside the property at any time. There are designated smoking areas on the property and signs are posted. No lit candles allowed. If evidence of smoking or candles being used inside the unit is found there will be a $250 fine.

 

5. No unattended children allowed on the balcony area at any time during the stay. Owner will not be responsible for any injuries to any guest of any age while using the balcony area. Use at your own risk.

 

6. Do not hang towels, bathing suits, clothing or any other items from balcony railing or entry railing. Outside hallway near unit door can be used to keep your own beach wagon, beach toys, etc. If using items from the Owner's storage closet outside the front door, all sand MUST be washed off before putting items back into closet. PLEASE be mindful of the other unit’s entry areas and do not infringe on their space.

 

7. No towels, linens, dishes, glassware, pots or pans, blankets, furniture, etc., shall be removed from the unit. Beach towels are provided for beach use.

 

8. Do not open the inside Owner's closet in hallway.  Any evidence of attempts to open or evidence of property taken out of closet will result in a $250 fine or cash amount of stolen or tampered with property.

 

9. Lost or broken TV remotes will result in a $100 replacement fee.

 

10. Please notify owner immediately if any damages to property or repairs that need attention such as plumbing issues, appliances broken or not working properly, electrical problems, etc., may have been overlooked or not reported by previous guests. The owner will address them and remedy any issues as soon as possible. If damages are not reported within the first 24 hours of your stay, you will be held responsible for damages/loss.

 

11.  No Permanent Residence. You agree that your use of the Property is on a temporary and transient basis only; that you may not use the Property as a permanent residence; and that your permanent residence is and will remain elsewhere than at the Property.

 

12. Consequences of Breach; Charges for Damage. Any failure by you or any other Occupants to comply with any of the terms, conditions, or policies above is a breach of this Agreement and may result in a forfeiture of your rights to rent the Property, up to and including immediate removal from the Property without refund and with or without the assistance of law enforcement. Owner may terminate this Agreement for breach, and if you are notified of such termination you agree to leave the Property immediately. In addition, you are responsible for the full amount of: (1) any damage or loss that occurs at the Property during your stay; (2) a charge of up to $250 for violations of the pet policy. (3) an additional cleaning fee of up to $250 (or the actual cost of cleaning services, if greater) for violations of any of the guest policies above or for excessive cleaning required by the acts or omissions of any Occupant during your stay; and (4) any fines issued by police, other government officials or agencies, utility providers, and/or homeowner associations for violation of any law, ordinance, or rule during your stay, and any damages (which may exceed the amount of fines) that result from the violation. If any unauthorized download of copyrighted material via the Property’s Internet service occurs during the period of your stay, you agree that we may share your contact information with the internet service provider or any other party we believe, for any reason, has enforcement rights.

 

 

DAMAGE DEPOSIT

 

13. The damage deposit ($500) will be returned within 7 business days of departure in the same manner your payment was made if there is no evidence of damages to property, loss of property or fines that may apply. Guest will be held responsible for any damages, losses or fines that exceed the damage deposit.

 

ADDITIONAL TERMS AND CONDITIONS

 

14. Cancellation Policy: If cancelled 60 days before arrival, rental payments are fully refundable (less any administration fees if applicable). For cancellations received 30 or more days before the first night of your reservation you will receive a 50% refund (less any administration fee). No full or partial refunds will be granted for no-shows or if you cancel less than 30 days before the first night of your reservation, arrive after the first night of your reservation, or depart before the last night of your reservation. If the owner doesn’t have the property available, except for inclement weather/acts of God (covered by your travel insurance), the guest will receive a full refund.  The owner will do everything in their power to make sure any mechanical, plumbing or electrical issues are fixed in a speedy manor.

 

15. Owner does not provide any type of Travel Insurance. Owner suggests that guests obtain appropriate and comprehensive travel insurance if desired. Third party travel insurance may or may not cover Renter and all Occupants and that includes coverage for personal injury, illness or disease, and property damage or loss, and to help protect against financial loss if you must cancel your reservation for a covered reason.

 

16. Early Check-In/Late Check-Out.  Early check-in or late check-out may be available; additional charges may apply. If you do not vacate by check-out time (or late check-out time as agreed by owner), you authorize owner to keep whatever amount owner feels appropriate from the Damage Deposit for the late departure (up to one night’s rental rate). Owner will not be responsible to ship, mail or hold any personal items that may be left behind by guest. Owner or Cleaners may ship or mail personal items left if guest provides the funds. Check-in: 4 P.M. Check-out: 10 A.M. Central Time zone.

 

17. Maintenance or Housekeeping Issues; Property Conditions. The Property is provided as is, and we are not responsible for the inoperability or unavailability of any amenities. Owner agrees to contact the appropriate person(s) as soon as you notice any maintenance or housekeeping problem, or any potentially hazardous condition, at the Property, or if any incident occurs at the Property that is related to such a problem or condition. You further agree to give the owner a reasonable amount of time to respond to your report and to cooperate with owner's efforts to address the concern or provide a remedy. We will take reasonable and appropriate steps to remedy any reported problem as soon as practicable. We may enter the Property at your invitation to remedy any problem you report, at reasonable times and with reasonable notice to inspect, maintain, or repair the Property, and to address any situation that we reasonably deem an emergency that threatens persons or property. You acknowledge that if the Property has access to amenities that are shared with other properties, such as a shared pool, grill area, parking lot, or fitness center, that the availability and condition of those amenities is outside owner’s control but the owner will alert the appropriate parties and ask on guest behalf that the matter's be taken care of as soon as is possible.

 

J. Limitation of Liability.

 

   J.1. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO CASE SHALL THE OWNER OF THE PROPERTY, NOR THEIR AFFILIATES, NOR THEIR RESPECTIVE OFFICERS, DIRECTORS OR EMPLOYEES, BE LIABLE FOR ANY DAMAGES FOR PERSONAL OR BODILY INJURY, ILLNESS OR DISEASE, EMOTIONAL DISTRESS, OR DAMAGE TO GUEST(S) PROPERTY, ARISING OUT OF OR IN CONNECTION WITH YOUR STAY AT THE PROPERTY.

 

K. Indemnity. You agree to hold harmless and indemnify the Owner, for and from all claims for property damage, personal injury, illness or disease, or monetary loss resulting from your actions or omissions, and the actions or omissions of other Occupants, during or relating to your stay.

 

 

 

 

I, __________________________________________ (Primary Renter and Photo ID Owner) agree to obey and adhere to all of the above rules, regulations and legal matters of this Rental Agreement. I understand that failure to do so could result in immediate termination of reservation, forfeiture of any monies and/or fines and fees taken from damage deposit. I also agree to pay any monies due for damages, loss of property, fines or fees that exceed the damage deposit paid.
